Chamber approves bill that allows states and municipalities to contract Embratur without bidding

The plenary of the Chamber of Deputies approved, on Tuesday night (9), Bill 545/24, authored by deputy José Guimarães (PT-CE), leader of the government in Congress. The text replaces Provisional Measure (MP) 1,207/2024, which authorizes public administration bodies and entities to hire Embratur, without the need for bidding, with the aim of promoting and supporting the commercialization of Brazilian tourist destinations, products and services in the exterior.

The legislation already allowed the Agency to sign contracts with private entities with the same objectives. Just like the MP signed by President Luiz Inácio Lula da Silva, Guimarães' text also paves the way for the Union, states and city halls to contract Embratur for the organization and logistical preparation of major events of international importance. This is an improvement to the Agency's legal regime with a text similar to that of the measure.

Another important point of the project is that, now, Embratur is once again authorized to receive funds from the Union Budget through the management contract signed between Embratur and the Ministry of Tourism (MTur). The authorization was terminated in 2020, when the body ceased to be a federal agency and was transformed into an agency with autonomous social service status, but without a defined source of resources. For the president of Embratur, Marcelo Freixo, the achievement benefits the country's tourism.

“It is important to highlight that Embratur does not seek profit. This benefit is for society as a whole, because when tourism wins, everyone wins. One proof is that tourism is one of the sectors that generated the most jobs after the pandemic. And now, with this flexibility, we will be able to do much more. The MP will allow Embratur to be an even greater partner with destinations in strategic projects, such as attracting and promoting new flights internationally”, he explained.

“We have experience in international promotion, data intelligence, and connection with the main operators in strategic markets, and all of this asset is at the service of the development of Brazilian tourism”, added Freixo. 

Agreement between Executive and Chamber
At the time of publishing the MP, the Minister of Tourism, Celso Sabino, had highlighted the importance of the update. According to him, with the changes, Embratur will be able to “perform its main activity of external dissemination of Brazil”. Last Tuesday (12), the Chamber approved the urgency regime for processing the PL. 

The reissue of the text in bill format follows an agreement between the President of the Republic and the President of the Chamber, Deputy Arthur Lira (PP-AL). Lira asked Lula to prioritize sending bills over MPs, and to determine constitutional urgency for the texts, so that parliamentarians could debate the matter within a maximum of 45 days. The agreement was made in 2023.
